The ex-husband of missing bookkeeper Heidi Planck has been granted full custody of their 11-year-old son as the search for the 39-year-old mom enters its fourth week.

James Wayne, 63, told UK tabloid The Daily Mail that he filed for custody on October 26, nine days after Planck left her son’s football game at halftime and was never seen again.

Wayne filed a missing person report when Planck didn’t pick up the boy from school on October 20 according to schedule, CrimeOnline previously reported.

Another mystery: Planck’s dog was found inside a downtown Los Angeles high rise 12 miles from her home on October 17, the day she left her son’s football game. Residents found the dog and took care of it until Wayne discovered the dog’s location and retrieved it. Police have since seized security footage from the apartment building.

According to court documents obtained by the Daily Mail, Wayne filed for full custody so he could put the couple’s son “into therapy immediately because he is completely distraught at his mother’s disappearance.”

Wayne also provided the Daily Mail with text messages he said his son sent to his mother in the days after her disappearance. The boy, who recently marked his 11th birthday, told Planck about the second half of the football game, then later wrote, “Can you please call me back I’ve called you two days in a row and you haven’t picked up.”

A few days later, he texted again: “Please call or just text me because I want to make sure you’re ok and I’m worried about you” and “And can you tell my dad if you’ll pick me up tommarow [sic] or not.” In another: “I really hope you’re ok and I love you.”

Police have said little about what they believe happened to Planck, including whether they believe foul play was involved. Wayne has been outspoken in his belief that her disappearance may be connected with her boss, Jason Sugarman, at Camden Capital. Sugarman is reportedly under investigation for an alleged $43 million fraud scheme; his partner has already been sentenced. Wayne said a Securities and Exchange Commission (SEC) official telephoned him on October 21 asking about Sugarman.
