Trump demands SCOTUS limit federal district court powers

The American Civil Liberties Union (ACLU) is leveraging its position in federal court to uphold and strengthen a ban on the government’s contentious plans to execute widespread deportations at will.

In a motion filed on Friday seeking a preliminary injunction, lawyers representing several formerly pseudonymous Venezuelan men appealed to Chief U.S. District Judge James E. Boasberg to fortify the current injunctive relief that prevents the Trump administration from fully implementing the Alien Enemies Act (AEA) of 1798.

At the outset, the plaintiffs say, the obscure 18th-century wartime authority “cannot be used” in the absence of an “invasion or predatory incursion” conducted by a “foreign nation or government.”

And, the motion argues, the government has since violated the law itself, ignored and misinterpreted relevant precedent, and put forward a framework for challenging removal that reads almost as Kafkaesque.
