Judge gives Elon Musk discovery win in Media Matters lawsuit

Wisconsin’s attorney general has petitioned the state’s Supreme Court to halt a proposal by President Donald Trump’s billionaire ally, Elon Musk. Musk plans to distribute two $1 million prizes to random individuals who sign a petition against “activist judges” and participate in the state’s upcoming Supreme Court election this Tuesday.

Democratic Attorney General Josh Kaul turned to the state’s highest court on Sunday following a denial of a similar request by a Wisconsin appellate court on Saturday. Kaul launched a lawsuit on Friday in light of Musk’s proposal—first announced on X—but was denied an urgent halt to the $1 million payouts by Columbia County Circuit Court Judge W. Andrew Voigt, who declined to review the lawsuit. The appeals court concluded that Kaul had not demonstrated Musk’s initiative as an illegal lottery, thus permitting it to proceed through the election on Tuesday.

In response, Kaul fired off his emergency petition to the Wisconsin Supreme Court asking it to take action — saying Musk’s offer is “blatantly unlawful” and “erodes public confidence in what is expected to be a close and highly consequential election,” per the filing.

“Wisconsin’s core interests in election integrity are near its zenith when the world’s richest man undertakes such an audacious effort to influence voting through monetary awards,” Kaul said in a memorandum voicing his support. “Wisconsin law prohibits offering anything of value to induce anyone to vote. Yet, Elon Musk did just that.”
