Judge slams FEMA for 'covertly' carrying out spending freeze

On Friday, a federal judge took action against the Trump administration by mandating that the Federal Emergency Management Agency (FEMA) disburses millions in grants and disaster relief funds to the states that challenged the federal funding halt in court.

In a detailed 15-page memorandum opinion and order, U.S. District Judge John McConnell, appointed by Barack Obama, determined that FEMA, guided by Homeland Security Secretary Kristi Noem, breached a preliminary injunction. This injunction prohibited the government from proceeding with its intended “categorical” budget reductions.

The government argued they complied with the court’s orders but the judge said the “record makes clear” that a so-called “manual review process” instituted by FEMA after the litigation began was a backdoor way to implement the verboten freeze.

“Thus, FEMA’s manual review process violates the court’s preliminary injunction order,” McConnell wrote in the Friday enforcement order.
