In a distressing case out of Gainesville, Florida, 23-year-old Travius Markell Davis was taken into custody on December 25, facing charges of sexual battery. The arrest follows a troubling accusation from a woman who claims Davis, with whom she was just beginning a relationship, assaulted her in her own home.

The incident reportedly unfolded on December 24, when the victim allowed Davis into her residence around 4:30 p.m. As events progressed, Davis allegedly followed her into the bedroom, unbeknownst to her, and subsequently locked the door. The situation escalated when, according to the victim, Davis picked her up, placed her on the bed, and overpowered her, leading to an unwanted and forced sexual encounter. Despite her attempts to resist and flee, she was unable to stop him.

Following his arrest, Davis provided a statement under Miranda rights. He claimed that he sought verbal confirmation from the victim about engaging in sexual activity, which he did not receive. Nonetheless, Davis interpreted her non-verbal cues as consent. He also noted that the victim concealed her face with a pillow during the act. After the incident, Davis admitted to having sexual intercourse with her and later sent text messages to apologize for advancing their relationship too quickly.

Currently, Davis is charged with sexual battery. His criminal record is otherwise clean in the local area. Judge Julie Johnson has ordered that Davis be held without bail, pending a forthcoming hearing. The State Attorney’s office has filed a motion to keep him detained without bail until his trial. Should the motion be denied, the judge will determine bail at the hearing.

Post Miranda, Davis reportedly said the victim did not reply when he asked her if she wanted to have sex, and he interpreted her body language as consent, although he said she held a pillow over her face during the sexual encounter. He reportedly admitted to engaging in intercourse with her and said that after he left, he sent her texts to apologize for rushing their relationship.

Davis has been charged with sexual battery. He has no local criminal history. Judge Julie Johnson ordered him held without bail pending a hearing on a motion from the State Attorney’s office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
