'From ear to ear': Suspect stabbed man on the beach after he wouldn't give him a cigarette or his cellphone, police say

In Miami Beach, Florida, a man faces serious charges after allegedly slashing another man’s throat over a cigarette and cellphone refusal.

Jack Daniel Gutierrez, 24, has been charged with aggravated battery using a weapon that resulted in severe injury, according to Miami-Dade County court documents accessed by Law&Crime.

Gutierrez is currently held without bond at the Turner Guilford Knight Correctional Center.

The incident reportedly occurred on October 23, 2025, when a man was taking a walk along Miami Beach near the 1700 block of Collins Avenue. Deciding to rest by a lifeguard tower, he was approached by Gutierrez, as detailed in an arrest report sourced by local Miami station WPLG.

Authorities report that Gutierrez first asked the man if he could spare a cigarette, but was told the man doesn’t smoke. Following this, Gutierrez inquired about using the man’s cellphone, only to be denied again.

Initially, the victim believed their interaction was over as Gutierrez appeared to leave. Unexpectedly, Gutierrez returned and attacked with “a knife or bladed weapon,” according to police, leaving the victim with a serious neck wound.

The suspect then ran away, but the victim “felt a heavy volume of blood pouring from his neck,” according to the report, which was also reviewed by McClatchy News. The victim was able to call 911 through a hands-free Siri application on his phone, and officers arrived to find him with a “large laceration along [his] neck from ear to ear.”

The victim was taken to a nearby hospital and treated. His current status is unclear, though WPLG reported he later identified Gutierrez in a photo lineup.

Police searched for the suspect and arrested him on Thursday.

Jail records show Gutierrez was on probation at the time of the attack on a weapons charge. He is expected back in court on Monday.
