Charlie Kirk killing: Judge to decide if a key hearing for Tyler Robinson will be public

A Utah courtroom is poised for a critical decision on Monday, as a judge considers whether to exclude journalists and the public from segments of an important upcoming hearing in the case against the man charged with the murder of Charlie Kirk.

Defense attorneys for Tyler Robinson have petitioned Judge Tony Graf to limit access to the preliminary hearing scheduled for July 6-10. During this hearing, prosecutors need to demonstrate sufficient evidence to proceed to trial. This event is anticipated to be the most comprehensive presentation of evidence thus far, in a case that has largely centered around issues of media access.

The defense has also moved to seal numerous exhibits that the prosecution intends to present at the July hearing, citing concerns that their exposure could bias potential jurors before the trial even begins.

Robinson’s legal team is keen on mitigating media coverage, which they claim has occasionally mischaracterized their client amidst the widespread public interest in the case. The 23-year-old, hailing from southwestern Utah, faces charges including aggravated murder related to the September 10 fatal shooting of Kirk at the Utah Valley University campus.

If convicted, prosecutors plan to pursue the death penalty against Robinson, who has yet to enter a plea.

While prosecutors argue that the preliminary hearing should remain accessible, they concur with the defense that certain sensitive exhibits should not be publicly viewed or copied, as they might play a role in the eventual trial. The evidence is expected to include forensic analyses, surveillance footage, witness statement recordings, autopsy reports, and alleged communications from Robinson confessing to the crime.

Authorities have said DNA consistent with Robinson’s was found on the trigger of the rifle used to kill Kirk, the fired cartridge casing, two unfired cartridges and a towel used to wrap the rifle. Prosecutors also have said Robinson left a note for his romantic partner that read, “I had the opportunity to take out Charlie Kirk and I’m going to take it.”
