Christa Pike execution failure spares murderer who bailed victim out just to kill him

Tennessee has paused the execution of convicted double murderer Gary Wayne Sutton after the state’s failed attempt to carry out the lethal injection of Christa Pike, who was sentenced to death for the torture and “satanic” murder of 19-year-old Colleen Slemmer in Knoxville in 1995. Sutton was convicted of killing a man he had helped bail out of jail and later murdering the victim’s sister when she searched for him.

Lee suspended executions across Tennessee for the remainder of the year. Sutton’s Dec. 3 execution was the only one scheduled during that period.

Sutton’s uncle and co-defendant, James Dellinger, died of natural causes on Tennessee’s death row in 2023.

Sutton has continued to maintain his innocence. However, in separate trials, juries convicted him in the murders of Tommy Griffin and Connie Branam, a brother and sister killed on Feb. 21 and 22, 1992.

Court records reviewed by News Outlet say Sutton had assaulted Griffin’s brother months earlier. On Feb. 21, 1992, Sutton went drinking with Dellinger and Griffin at Howie’s Hideaway, a bar in Tennessee.

After leaving the bar, the men became involved in a fight. Sutton and Dellinger then left Griffin on the roadside, where a passing motorist found him and flagged down a police officer, according to court documents.

The officer described Griffin as “on the verge of tears.” He was shirtless, with scrapes and scratches across his upper body and a cut behind his ear. Griffin said he had argued with “some friends, who were not really his friends,” according to court records.

Griffin declined to provide more details and was arrested on a public intoxication charge. Sutton and Dellinger later arrived at the police station to bail him out at about 8:30 p.m., but officers told them to return. They came back around 11:30 p.m. carrying a flannel shirt, court documents state.

About 30 minutes later, witnesses reported hearing three gunshots near the location where Griffin’s body was eventually discovered. He had suffered a shotgun blast to the head.

The following day, Griffin’s sister, Branam, went to Howie’s Hideaway with Sutton and Dellinger. She told a server that she was looking for her brother. Her body was later found inside her burned-out car. The vehicle was so badly damaged that the forensic pathologist could not determine whether Branam was alive when the fire began. Investigators did recover a .303 cartridge that matched a rifle found at Dellinger’s home.

Sutton’s supporters have argued that the prosecution’s case was circumstantial. Questions remain about who shot Griffin and precisely how Branam died.

Sutton was scheduled to be executed Dec. 3, but that date has been placed on hold after Tennessee failed to complete Pike’s execution the previous week.

Pike’s failed execution was Tennessee’s second botched execution this year. In May, executioners were unable to locate a suitable vein for another condemned prisoner, Tony Carruthers.

Pike’s next legal and medical steps remain uncertain. She is being treated at an undisclosed hospital after receiving two doses of lethal injection drugs that failed to kill her. Lee said Carruthers will not face another execution attempt for at least a year after his scheduled May execution was canceled.

Pike, who remains hospitalized in critical condition, is the first person known to have survived the administration of lethal injection drugs, according to the Death Penalty Information Center, a nonprofit organization that tracks capital punishment in the United States.

In 2014, an Oklahoma inmate named Clayton Lockett initially survived the injection but died of a heart attack while still inside the chamber, according to the center.
