Kim Zolciak’s Son KJ Biermann, 15, Pleads Not Guilty to Sexual Assault

Kim Zolciak and Kroy Biermann’s son, Kroy “KJ” Biermann Jr., has pleaded not guilty to charges stemming from an alleged sexual assault involving a female classmate. The 15-year-old is out of jail on a $200,000 bond.

According to legal documents obtained by Our News Outlet, KJ entered not-guilty pleas to aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16.

His attorney, Jason Sheffield, filed the plea with Fulton County Superior Court on Monday and waived KJ’s formal arraignment, which is currently scheduled for next Wednesday.

Sheffield also asked the court to schedule a hearing in Fulton County Juvenile Court.

The Daily Mail contacted the teenager’s attorney for comment but has not received a response. Zolciak declined to comment.

The development comes weeks after KJ returned home to his famous mother following nearly a month behind bars.

According to TMZ, KJ was released on a $200,000 bond more than two weeks ago after being charged in an alleged sex assault involving a female classmate.

A source told the outlet that KJ is staying with the 48-year-old Real Housewives of Atlanta star, who has full-time care of the teenager as her contentious divorce from former NFL player Kroy Biermann, 41, continues.

Returning to Zolciak’s home—despite previously calling her a “horrible example of a parent” in police body-camera footage—was one of the conditions of KJ’s bond. He is also required to attend school virtually.

The bond conditions further prohibit the teenager from using social media or a cellphone, and require him to wear an electronic monitoring device.

KJ is also prohibited from having direct or indirect contact with the alleged victim, her family or anyone under the age of 16.

Fulton County Superior Court Judge Melynee Leftridge approved KJ’s release on bond in a Georgia court the previous week, nearly one month after his August 17 arrest.

The alleged incident involving the female classmate reportedly took place at a Life Time fitness center in Alpharetta, Georgia, on April 23.

A grand jury indicted the teenager on seven felony charges: aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of sexual battery against a child under 16 and false imprisonment.

Deputy District Attorney Caitlin McGillicuddy told the court that KJ had previously been charged with sexual battery of a minor in October 2025—six months before the alleged incident involving his classmate.

That case was adjudicated in juvenile court and KJ is currently under court supervision, which is set to expire in 2027.

KJ’s attorney Jason Sheffield denied McGillicuddy’s claims, telling Our News Outlet in a statement: ‘The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.’

‘The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense. Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.’

In the plea for KJ’s bond pertaining to the April allegations, Sheffield told the judge: ‘This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet.’

McGillicuddy responded by saying that the alleged victim in the April case had suffered ‘documented physical injury’ as a result of the alleged incident, which she described as ‘predatory.’

Earlier this month, Sheffield filed a transfer request with the Fulton County Court to move KJ’s case to Georgia’s juvenile justice system, arguing that the teen is young enough to be rehabilitated.

KJ was supported by his parents Kim and Kroy at his bond hearing, as he could face a 25-year prison sentence due to multiple felony assault charges related to the alleged sexual assault.

Meanwhile, Zolciak and Biermann are in the middle of a very contentious separation and divorce which has yet to be finalized, but the two put their differences aside and put on somewhat of a united front at the latest court hearing.

Zolciak remained ‘stone-faced’ while sitting beside daughter Brielle, 29, while Biermann looked ‘stressed’ according to an eyewitness for the publication.

Zolciak and daughter Brielle refused to answer any questions about the case from reporters while leaving the court room.

Last month the matriarch, who appeared on The Real Housewives of Atlanta, hit out at the allegations and maintained KJ’s innocence in a statement to Our News Outlet as she branded them ‘reckless and deeply troubling.’

Zolciak said: ‘He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.

‘My son voluntarily took a polygraph examination regarding these allegations and passed,’ she claimed.

‘Additionally, an examination was conducted, and no DNA belonging to my son was found.’

‘We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.’

Earlier this month Zolciak’s RHOA co-star NeNe Leakes revealed she reached out to the star to ‘make sure she was okay.’

‘I recently spoke to Kim. I think it was last week. I just hit her up, wanted to know how she was doing, and made sure she was okay with what her son is dealing with,’ Leakes said on the Big Tigger Morning Show.

‘I know that’s a tough time and I know she’s not okay. So I just wanted to reach out and I did.’
