Trump Must Testify In New York Financial Fraud Probe, Court Says

A New York appellate court on Thursday ruled former President Donald Trump must testify in New York Attorney General Letitia James’ (D) investigation into potential fraud by the Trump Organization, marking the latest legal blow for the ex-president.

Key Facts

James said Trump’s two oldest adult children, Ivanka and Donald Jr., have also been directed to “appear before my office to testify under oath.”

Eric Trump, the former president’s middle son, appeared for a deposition in the probe in 2020.

Margo Martin, a spokeswoman for the former president, did not immediately return a request for comment from Forbes, though he has on numerous occasions decried the investigation as a politically driven “witch hunt.”

Key Background

James’ civil investigation is focused on whether the Trump Organization and its leaders knowingly misvalued assets for financial gain, through inflating them to secure loans and undervaluing to save on taxes. Trump has shown little willingness to cooperate with the investigation since it began in 2019, sparked by his former personal attorney, Michael Cohen, who told Congress Trump and his business associates had routinely misvalued assets. Trump last week paid James’ office a $110,000 fine over a contempt ruling against him for failing to comply with a subpoena requesting Trump Organization financial records, which Trump’s lawyers said he did not possess. James could bring a lawsuit against Trump if her office determines the former president engaged in financial wrongdoing, but Trump is facing criminal probes over similar allegations in Manhattan and Westchester County, New York.

Surprising Fact

Trump appeared for a deposition in October in a separate case brought by a group of Mexican protesters who claim Trump’s security guard assaulted them while they protested outside Trump Tower in 2015.

Trump is also facing a criminal probe in Fulton County, Georgia, related to his efforts to overturn the 2020 election results in the state.
