Brett began his legal career as a law clerk, then as a postgraduate working for Judge Ken Starr. Brett assisted Starr with various investigations involving President Bill Clinton after Starr left the D.C. Circuit to become the head of the Office of Independent Counsel.

Following the 2000 presidential election in the United States, he joined the Bush administration as White House staff secretary, and he was also a key figure in the administration’s efforts to identify and confirm judicial nominees.

Bush nominated Brett to the United States Court of Appeals for the District of Columbia Circuit in 2003. Similarly, his confirmation hearings were contentious and stalled for three years due to partisanship allegations.

After a series of negotiations between Democratic and Republican U.S. senators, Brett was finally confirmed to the D.C. Circuit in May 2006. Similarly, on July 9, 2018, President Trump nominated Brett Kavanaugh to the United States Supreme Court. As a result, to fill the vacancy left by retiring Associate Justice Anthony Kennedy.

Allegations of Sexual Assault

During Brett’s hearing, Palo Alto University professor Christine Blasey Ford testified, accusing him of drunkenly pinning her down and sexually assaulting her when they were teenagers in the 1980s. As a result, ‘The Washington Post’ published her account, in which she stated,

“I thought he might inadvertently kill me. He was trying to attack me and remove my clothing.”

Brett, on the other hand, refuted the claims, saying,

“I categorically and unequivocally deny this allegation. I did not do this back in high school or at any time.”

Then, just one week after Ford’s claim, a second woman came forward. As a result, Deborah Ramirez claimed that he exposed himself to her at a Yale party when they were both freshmen. Brett, however, denied the accusation once more, calling it “a smear, plain and simple.”

Similarly, Julie Swetnick, a third woman, accused him of sexually aggressive behavior in high school while at alcohol-fueled parties. After a two-day hearing in which both Ford and Brett testified, the Senate Judiciary Committee voted along party lines to move Brett’s nomination to the Supreme Court forward.

Furthermore, Republican Jeff Flake has requested a one-week delay.

“to let the FBI do an investigation limited in time and scope to the current allegations,”before the Senate ultimately decided to advance Kavanaugh’s nomination.

In addition, the Senate Judiciary Committee held a follow-up hearing on Ford’s allegations. In which sexual violence experts are described as credible. The committee then voted to send the confirmation to a full Senate vote. On October 6, the full Senate confirmed Brett by a vote of 50–48.
