Deputy District Attorney Pippa Cunningham claims that Xavier was driving while under the influence of alcohol and Xanax when the automobile wrecked at Tecolote Creek.
Waller was seriously hurt and died in the hospital three days later.
Cunningham said Thursday that “Jenny was able to get out, but sadly her passenger ended up drowning,” adding that detectives discovered other evidence on Xavier’s smartphone showing she had been in previous wrecks while under the influence of drugs or alcohol.
