A Texas man faces a lengthy prison sentence after a violent altercation led to the death of a wheelchair-bound individual who had previously undergone the amputation of all his toes. This tragic incident has stirred significant attention and raises questions about violence and public safety in urban settings.

On Thursday, 33-year-old Hayden Humphreys chose to plead guilty to the charge of manslaughter in connection with the death of Rudy Ricky Diaz, aged 38. The fatal confrontation occurred in Houston on July 23, 2022, along the 18000 block of McKay Drive, shortly before midnight. Humphreys, having just left a nearby club, encountered Diaz during his walk, as detailed in a probable cause arrest affidavit.

According to Humphreys, Diaz, seated in his wheelchair, initially requested money. After Humphreys obliged, Diaz allegedly demanded more and then “stood up” in a manner Humphreys perceived as threatening. This, Humphreys claimed, prompted him to strike Diaz in self-defense. However, eyewitness accounts painted a different picture, describing Humphreys aggressively attacking Diaz, who was already lying unresponsive on the ground.

Local witnesses familiar with Diaz described him as “harmless” and not someone who posed a threat. This characterization of Diaz adds a poignant dimension to the tragedy, underscoring the loss of a vulnerable community member.

Diaz was swiftly taken to the hospital by paramedics, but despite medical efforts, he succumbed to his injuries approximately two weeks later. The cause of death was confirmed as blunt force trauma through an autopsy.

Investigators who reviewed surveillance footage from the scene documented Humphreys’ erratic behavior, which suggested intoxication. Indeed, Humphreys admitted to consuming several drinks that evening, which may have contributed to his actions.

While in jail, Humphreys talked to his father on a recorded jail call in which he said he wanted to go out drinking on the night in question but no one wanted to go out so he decided to go by himself. He said when he goes out, “dumb s— like this happens” and also stated “when I”m left alone, I’m a f—ing child,” the affidavit said.

Humphreys claimed he blacked out and didn’t remember the incident. His father admonished him for being “stupid” while drinking.

“I know I lost my f—ing mind that night,” Humphreys said, per the affidavit. “I know I did.”

The defendant was originally charged with murder but pleaded guilty to manslaughter as part of a deal with prosecutors. He’s facing eight years in prison when he’s formally sentenced on Dec. 1, local ABC affiliate KTRK reported.

All 10 of Diaz’s toes were amputated a few months before the incident, his brother Benji Diaz told KTRK. He wishes Humphreys could be sent to prison for longer.

“Anybody who is out there hurting people in that type of manner or taking advantage of people who can’t defend themselves,” the brother told the TV station. “I don’t think they deserve to be free at all.”
