Social media influencer Emilie Kiser entrusts her husband, Brady, with their two young sons, 3-year-old Trigg and 5-week-old baby Theodore, while she takes a break to enjoy dinner with friends.

Brady is feeding the baby a bottle when Trigg finishes his dinner and heads outside to play in the backyard.

Brady is seated, feeding Theodore a bottle, as he keeps an eye on Trigg playing in the backyard. The 3-year-old explores the grassy area, featuring a blow-up slide, a playhouse near the swimming pool, and an elevated spot with a hot tub.

Brady says he went into the house to get a drink, and when he went back outside, Trigg was in the water of the swimming pool.

Setting the infant on the ground, Brady takes off his shirt and dives in the pool and grabs Trigg, who is unconscious and not breathing.

In a panic, Brady rushes Trigg inside and lays him on the floor, starting CPR and calling 911 simultaneously. As he gives breaths to the child, Trigg expels food and water.

Emergency services, alerted by Brady’s call, dispatch police and fire rescue. Upon arrival, the police take over chest compressions, while Brady goes outside to get baby Theodore.

Brady insists to the police that he was only away from Trigg for a brief period—just moments, not minutes. After further questioning, he concedes that it might have been three to five minutes.

Following a two-month investigation, the Chandler Police Department announces their recommendation of a felony charge against Brady Kiser in the tragic drowning of his three-year-old son, Trigg.

The Class 4 felony charge of child abuse against Kiser was submitted to the Maricopa County Attorney’s office.However, the Maricopa County Attorney’s Office opted not to charge Brady Kiser because the case did not meet the standard of a “reasonable likelihood of conviction.”
