Recent actions by President Donald Trump have raised significant concerns about whether the United States’ democratic republic is being threatened. Of particular note is the president’s use of the Alien Enemies Act of 1798, which has ignited discussions regarding the balance of power among the government’s three branches.

Is America In A Constitutional Crisis?

According to Burns-Tucker, the U.S. was established on principles designed to preserve the value of liberty. Specifically, a system known as checks and balances was implemented to allow each branch of government (executive, judicial, and legislative) to function effectively while safeguarding public interest and power equilibrium. However, Trump’s recent actions have put these principles under scrutiny.

Burns-Tucker points out that Trump’s application of the Alien Enemies Act of 1798 has raised questions about the extent of authority granted to the executive branch. As noted by the Brennan Center, the Alien Enemies Act of 1798 is a “wartime power that permits the president to detain or expel the natives and citizens of an adversary nation.”

“Trump used this law for the first time since World War II to target individuals allegedly linked to a Venezuelan gang as part of what this administration calls ‘a mandate by the American people to crack down on immigration in this country,’” the host explained.

Despite this, a federal judge reportedly ruled against Trump’s invocation of the order, questioning its legality.

According to Burns-Tucker, it remains unclear “whether the Trump administration complied with that order or defied it.” Regardless, the host says, Trump reacted by reportedly calling for the judge to be impeached.
