TALLAHASSEE, Fla. – A self-identified transgender protester from Illinois was arrested after entering the wrong restroom last month, according to the Florida Capitol Police.
In an affidavit, police said that the protester — Luke “Marcy” Rheintgen, 20 — had previously sent a letter to Capitol Police warning that Rheintgen would be coming to the Florida Capitol Building to break the law as a “transgender woman” entering the women’s restroom.
On the afternoon of March 19, police said they made contact with Rheintgen on the second floor of House Office Building of the Florida State Capitol, explaining that Rheintgen wasn’t allowed to use that restroom.
“Rheintgen acknowledged the warning, said, ‘I am here to break the law’ and proceeded to enter the women’s restroom,” the affidavit reads.
An officer then went into the restroom and gave Rheintgen a trespass warning, though Rheintgen explained that “he did not agree with the law and did not want to leave,” investigators wrote.
As a result, Rheintgen was ultimately arrested and now faces a charge of trespassing after warning, court records reveal.
Rheintgen’s arrest comes in the wake of a 2023 law (HB 1521) that requires people in Florida state buildings to use restrooms that correspond to their sex.
Under this law, purposeful violations can be met with trespassing charges — second-degree misdemeanors that can be punished with up to 60 days in jail.
