ERWIN, Tenn. (WJHL) — Erwin Police Chief Regan Tilson, who was put on administrative leave in July following an unsuccessful breathalyzer test, has been dismissed, as announced by the Town of Erwin.

The release said the following about the failed breathalyzer, which Tilson took on June 30:

“Chief Tilson’s initial breathalyzer at 11:04 AM displayed a BAL of .080 and a subsequent test at 11:21 AM showed a BAL of .066. According to the Town of Erwin Drug and Alcohol Testing Policy for safety-sensitive roles, the acceptable limit is a BAL of .04. Thus, Tilson’s secondary result of .066 was a failed test.”

The statement indicated that considering the outcome of Tilson’s test and following an investigative process, the Town Recorder decided that Chief Tilson’s dismissal was justified.

According to the release, the Mayor can appeal the termination within five days of Friday’s decision.

Major Tony Buchanan will continue to serve as interim Chief of Police for the Town of Erwin, according to the release.

Tilson’s attorney told News Channel 11 that he plans to appeal the decision.

A release from Tilson’s attorney said Chief Tilson “denies any use of alcohol while on duty.”
