NEW YORK – FedEx announced on Thursday its commitment to refund any tariff reimbursements it receives back to the shippers and customers who initially paid those fees.
This declaration follows FedEx’s legal action in the U.S. Court of International Trade, where it sought to reclaim tariffs imposed by former President Donald Trump under the International Emergency Economic Powers Act. Last Friday, the Supreme Court deemed these tariffs unlawful.
Over 1,000 businesses, including major U.S. companies like Costco and Revlon, have similarly pursued legal action in the U.S. Court of International Trade to recover costs associated with these now-illegal tariffs.
“Should FedEx receive refunds, we are committed to passing them on to the shippers and customers who were initially charged,” the company stated on Thursday. “The timing and process for these refunds will largely depend on forthcoming guidance from both government entities and the court.”
The recent Supreme Court decision did not provide details on how those who paid the tariffs might receive their refunds.
Establishing a refund mechanism is expected to take time. Earlier this week, the Liberty Justice Center, known for its libertarian stance and involvement in the Supreme Court case, along with co-counsel Neal Katyal, submitted motions in both the U.S. Court of Appeals for the Federal Circuit and the U.S. Court of International Trade to initiate a refund process. A governmental response is anticipated by Friday.
“We are committed to transparency and will communicate clearly as additional direction becomes available from the U.S. government and the court,” FedEx’s statement said.
