Menendez brothers will be paroled eventually, lawyer predicts

Although the California state commissioners decided this week to deny parole to the Menendez brothers, they also offered a guide on how these convicted individuals might improve their chances for future parole opportunities, according to criminal defense lawyer Mark Reichel.

The California Board of Parole members turned down the parole requests of Erik and Lyle Menendez, citing several rule violations while they were incarcerated. Notably, both brothers were caught with unauthorized cell phones, a major breach of prison regulations, and Erik faced additional discipline for violent behavior and misconduct during visits.

Parole officials essentially advised each brother to ensure their genuine selves align with the image of remorse and reformation that their advocates have been presenting.

“They’ve been given a benchmark of what they must achieve to succeed,” Reichel mentioned on “Prime” on Saturday. “I believe they now understand what’s required to secure their release.”

Each sibling won’t be eligible for parole for three years, but could seek to return earlier, in 18 months, through an administrative process.

Reichel, who initially thought the brothers had a favorable chance, speculated that they might achieve parole in perhaps two more hearings. He described it as a near decision regarding Erik and Lyle Menendez’s potential release, noting that the assessment identified them as a “moderate” risk for reoffending.

Erik, aged 54, and his 57-year-old brother Lyle, were sentenced for the 1989 murders of their parents in Beverly Hills using a shotgun and have been incarcerated for 30 years.

Their case has received renewed attention through streaming programs and claims the pair were sexually abused by their father. But Los Angeles County District Attorney Nathan Hochman has opposed their release, saying the brothers have never accepted responsibility for their actions or told the complete truth.
