Woman watching child in Las Vegas drowning wasn't sober: Police

LAS VEGAS (KLAS) — A woman who was taking care of a 5-year-old boy when he drowned admitted to drinking alcohol, according to a police report affiliate KLAS obtained. 

Jaxenn Garcia died on June 28 at an apartment complex near Flamingo Road and Nellis Bouelvard. 

In an incident report from the Las Vegas Metro Police Department, officers said that the adult caused the child to “suffer unjustifiable physical pain or mental suffering as a result of negligent treatment or maltreatment of a child.” Police added that a report of “child abuse, neglect, or endangerment was taken” due to the drowning. The name of the person was redacted in the incident report.

KLAS interviewed the child’s father, Alexander Garcia, on Monday in an exclusive interview where he asked for justice in his son’s death. 

“Justice for Jaxenn is spreading awareness for something like this. It should never happen again. And you know, the people [who] were there, I mean I think that [they] should be held responsible,” Alexander Garcia said. “You were ultimately there to watch someone who mattered to you, and you failed at the job.”

According to police, footage from the apartment building revealed Garcia fell in the deep end of the pool and no one was supervising him at the time. A witness told officers the child was in the water for approximately four minutes. 

When detectives spoke with the person watching Garcia, they “could detect the scent of alcohol on her breath,” and she admitted to having a BeatBox and a Monster energy drink, according to the report.

Officers performed lifesaving efforts on Jaxenn Garcia once they arrived, but he was unfortunately pronounced dead at Sunrise Hospital.
