AUSTIN (KXAN) A man in Texas has been taken into custody for supposedly breaking into an animal shelter and setting most of the dogs free from their kennels, local authorities report.

Jacob G. Bender, 38, is facing criminal trespass charges.

The incident resulted in one dog’s death and at least five dogs suffering injuries. The shelter, Austin Pets Alive!, confirmed that all the missing dogs have been located and accounted for.

The break-in occurred around 1:20 a.m. local time on Aug. 14. However, officers were not notified of the incident for hours. 

The Austin Police Department stated that officers responded to an urgent burglary call at APA! around 5 a.m. Staff later arrived at the facility, secured the animals, and returned them to their enclosures.

This case is under investigation by the Animal Cruelty Unit. According to APD, Bender may face additional charges.

Attorney information was not listed for Bender as of Monday.
