Adamu Aliero’s nomination as the Peoples Democratic Party (PDP) candidate for the Kebbi central senatorial district in the upcoming national assembly elections has been upheld by the Supreme Court.
On Monday, four judges on the supreme court bench reversed the lower court’s ruling.
On September 28, 2022, Aliero’s candidature was overturned by the Sokoto appeals court, which consequently confirmed Saidu Haruna as the legitimate Kebbi central candidate.
However, a supreme court justice, Centus Nweze, ruled that Aliero’s appeal “is pregnant with merit and is accordingly allowed.”
Amina Augie, who read the lead ruling, said, “The judgement of the lower court, which declared Saidu Haruna as winner of the Kebbi central senatorial district primary election is hereby set aside.”
The presiding judges noted that both the appellant and the first respondent (Haruna) took part in the primary rerun election for Kebbi Central on June 9, 2022, which the appellant ultimately won.
The Supreme Court ruled that Haruna had forfeited his right to appeal because he had taken part in the rerun.

The court ruled that Haruna, as the first respondent, “withdrew his petition against the conduct of the May 24, 2022, primary election” by participating in the rescheduled primary.
For the Kebbi north senatorial constituency, the Supreme Court also ruled that Yahaya Abdullahi said the People’s Democratic Party candidate.
The appellate court had ruled against Abdullahi’s candidature on September 28 and in favour of Sani Argungu; therefore, on October 2, he filed an appeal with the highest court in the land.
After reviewing the case, the Supreme Court concluded that the lower court did not have the authority to do so.
They ruled that the lower court had no jurisdiction to take up the case.
“Judgment is hereby entered in favour of the appellant.
“Judgment of the court below is thereby set aside.”
