Dr Phil dragged into Rebecca Grossman case after husband's interview

The ongoing wrongful death lawsuit involving socialite Rebecca Grossman took an unexpected turn on Friday, drawing well-known TV personality Dr. Phil into the spotlight.

In a recent court filing, the attorneys for the devastated parents of two young boys who tragically died in a 2020 hit-and-run incident are seeking the unedited footage of a podcast interview featuring Grossman’s husband, conducted by Dr. Phil.

Dr. Peter Grossman participated in Dr. Phil’s two-part podcast series titled Fatal Accident: Inside the Rebecca Grossman Case last month, where he staunchly defended his wife’s innocence and shifted the blame towards her former partner, World Series champion pitcher Scott Erickson.

Rebecca Grossman is currently serving a sentence of 15 years to life at the California Institution for Women in Corona, following her conviction for the deaths of brothers Mark, 11, and Jacob Iskander, 8, who were struck at a pedestrian crossing in Westlake Village in September 2020.

Meanwhile, Erickson, who was allegedly racing Grossman at the time of the crash, initially faced a misdemeanor reckless driving charge which was later dismissed. However, he remains a defendant in the civil lawsuit filed by the boys’ parents, Karim and Nancy Iskander.

In their latest legal move, the Iskanders assert that Peter Grossman, a prominent plastic surgeon, went to considerable lengths during the January 13 interview to absolve his wife of any wrongdoing, while detailing his version of how the tragic event occurred.

The episode of the Phil in the Blanks podcast has now been taken down. 

Now their legal team wants to see what didn’t make it to air and are demanding Dr Phil turn over ‘the entire, unedited raw footage’.

‘Notably, they also complained they could not get a fair trial because of bad press coverage.

‘Turns out, Peter Grossman set up an interview with Dr Phil and sent him (or his team) case documents and evidence.

‘Considering the podcast discussed how the collision occurred – an issue that is hotly contested – they should be produced, especially because there could be footage that was edited out for time purposes,’ the filings state. 

The Iskanders’ motion goes on to ask Los Angeles Superior Court Judge Huey Cotton to compel Peter Grossman, who is also named in the lawsuit, to surrender ‘all communications between you and Dr Phil’ about the crash and ‘all documents that show how much you paid’ to be on the podcast.

In their quest for substantial cash damages, the Iskanders are also seeking detailed documents and information about the considerable wealth and ‘suspicious’ property dealings of Rebecca Grossman who was convicted on two counts each of second degree murder and vehicular manslaughter, plus one of hit-and-run.

In particular, they want to know if Peter Grossman was trying to hide a valuable asset by recently transferring title to the couple’s spectacular, $13.5 million hilltop mansion in Hidden Hills to a mysterious entity called the JB Road Trust, ‘which Peter Grossman inexplicably could not identify the members and beneficiaries of’, said the motion.

‘The home’s curious ownership history after the fatal collision is highly suspicious,’ attorney Owen wrote, adding it is ‘more likely than not’ a potentially fraudulent transfer.

Judge Cotton is expected to rule on the new ex-parte motion on Tuesday February 17, which is just two days before a scheduled mandatory settlement conference (MSC) where the Grossmans and Erickson have a final opportunity to make a cash settlement with the Iskanders before the case goes to a jury trial that’s set for April.

Owen explained that new motion ‘seeks documents and information directly relevant to damages and Rebecca Grossman’s financial condition…..and the Iskanders need this information to fairly evaluate their settlement options at the MSC.’

Grossman’s defense lawyers have objected to every one of the Iskanders’ 32 ‘requests for production’ of documents and new information.

They claim many of those request are ‘overly broad, vague and ambiguous’ and ‘unduly burdensome, harassing and oppressive’. 

Some are a violation of the Grossmans’ privacy, they say, while others are irrelevant.

During Grossman’s criminal trial in early 2024, the jury didn’t buy her defense team’s story that the real person to blame for the deadly crash was Erickson who was allegedly racing her in his black Mercedes after the two had drunk cocktails over lunch.

But he was only charged with misdemeanor reckless driving. And his case was resolved in February 2022 with a judge giving him a slap on the wrist, ordering him to make a public service announcement for high school students about the importance of safe driving.

Now facing a wrongful death civil lawsuit, Erickson has filed several motions trying to minimize the role the Iskanders accuse him of having in the death of their sons.

He has asked Judge Cotton to ban the jury from reading the WhatsApp messages between him and Grossman, many of which are affectionate and contain personal references to their affair which started when she was separated from her husband.

In one message, Grossman confessed to Erickson that although she loved him, she went back to her husband because he was paying ‘an enormous amount of money’ on legal bills to defend her against double murder charges.

Erickson claims the text exchanges are ‘overwhelmingly irrelevant’ and ‘highly prejudicial’. 

The Iskanders’ attorneys countered, saying they are ‘directly relevant because they contain certain admissions and factual statements about the fatal collision’.
