Shooting near I-65 overpass ruled a justifiable death, BPD reports

BIRMINGHAM, Ala. (Trussville Tribune) — The Birmingham Police Department has determined that a shooting on Saturday morning, which resulted in a fatality, is a justifiable death.

The man killed in the shooting was identified as 38-year-old Anthony DeAngelo Avila.

Police reports indicate that Avila and another person were allegedly engaged in a verbal dispute that started at the Church of the Reconciler and continued to the 1000 Block of 2nd Avenue North, where Avila was shot and killed.

BPD’s Crime Reduction Team responded to the scene and took a person of interest into custody without any incident.

The suspect was later placed on a 48-hour felony extension while investigators conducted a more thorough investigation.

On Sunday, BPD Homicide detectives presented the case findings to the Jefferson County District Attorney’s Office for review.

After assessing the evidence, the District Attorney’s Office ruled that the actions were justifiable.

The investigation has been reclassified as a justified death investigation
