Driver who struck and killed jogger in front of his wife sues victim’s family for his emotional damage

In a surprising turn of events, the motorist responsible for a tragic accident that claimed the life of a jogger is now pursuing legal action against the victim’s family, alleging he suffers from post-traumatic stress disorder.

Gavin Maas, aged 25, was involved in the fatal incident that took the life of 37-year-old Anthony Miller, a dedicated father and acclaimed nurse, during a morning run with his wife, Bailey Miller, last August.

According to the police report, Maas stated that he attempted to steer clear of Bailey Miller upon noticing her reflective attire but failed to spot her husband dressed in dark clothing amid the dim, rainy conditions.

After the collision, Maas promptly halted his vehicle to administer emergency aid. Authorities did not issue him a citation, attributing the accident to inadequate lighting and adverse weather conditions.

Despite not being held legally accountable for the accident, Maas claims the incident has left him emotionally scarred, resulting in multiple hospitalizations. He is now seeking $50,000 from the Miller family to compensate for his medical expenses and lost earnings, as reported by KOLN.

Anthony Miller, a recipient of the Daisy Award for his exceptional work as a trauma nurse at Nebraska Medical Center, had been assisting his wife in preparing for an upcoming half-marathon when the fatal accident occurred.

He was also a great “girl dad” to their two young daughters, Annalise and Keely, according to his wife of seven years.

“The biggest honor for him was to be a dad,” his widow said. “He loved our girls so much.”
