Federal Judge Throws Up Another Roadblock to Prevent Trump From Ending the Biden Parole Program

Judge Indira Talwani of the U.S. District Court, District of Massachusetts, has created another obstacle for President Donald Trump’s initiative to deport illegal immigrants who received parole under the Biden-Harris administration. More than 875,000 undocumented individuals from Afghanistan, Latin America, and Ukraine were permitted entry into the United States through sponsorship by American citizens. Eight of these individuals, along with their American sponsors and a San Diego non-profit, have formed a class that Judge Talwani certified, effectively halting the deportation or removal of any member of this class until the legal proceedings have concluded:

On Wednesday, U.S. District Judge Indira Talwani of Massachusetts mandated the Trump administration to continue processing applications from these migrants who are applying for work permits or renewing their status.

Sponsors Sandra McAnany, Wilhen Pierre Victor, and Kyle Varner spearheaded efforts to initiate the lawsuit, with support from the Haitian Bridge Alliance—a San Diego-based non-profit organization that assists Haitians and others in entering the United States.

These citizens and the non-profit are primarily West Coast-based, so how did the lawsuit end up in a different jurisdiction? Attorney Esther Sung, the Legal Director for the Justice Action Center, partnered with Human Rights First, a New York-area human rights organization whose board includes former NAACP President Ben Jealous and former Obama press secretary Jay Carney. According to Influence Watch, the group “seeks to influence through lobbying and litigation the United States government to make changes to the immigration system to accept more refugees.”

So, lest anyone thinks this is an organic outcry of grassroots organizations fighting on the side of immigrants, understand that under Trump 2.0, those days are gone. These legal challenges continue to show that the Resistance considers lawfare its only option to shut down the Trump administration’s control of illegal immigration: 

The migrants were granted a two-year “parole” to live in the country under programs established by former President Joe Biden. The programs let migrants and their immediate family members fly to the United States as long as they had sponsors in America. Then, they would be placed on parole for two years.

However, the Trump administration has been trying to end all parole programs as part of its immigration crackdown and has already asked the Supreme Court to weigh in on the matter. President Donald Trump signed an executive order on Jan. 20 directing the government to end “all categorical parole programs” set up during the Biden administration.

Riddle me this: If, according to Judge Talwani, Trump does not have “broad discretion” to end this program, why then did President Joe Biden, or whoever was in charge that day, have broad discretion to administer and alter this program? Someone make it make sense.

The majority of the legacy media is fixated on the tariff wars and that court ruling. However, Trump winning the day on immigration is equally critical. As was the case of Trump’s use of the Enemies Alien Act, and the 300,000 Venezuelans under TPS, SCOTUS will have to become involved here.
