McIver, two House Democrats, and Mayor Ras Baraka toured the new ICE facility on May 9, 2025, per The Independent.

The situation intensified when officers detained Baraka for trespassing. Nick Sortor posted on X, revealing body cam footage that shows McIver approaching the officers during Baraka’s arrest and making physical contact.

The video captures the alarming chaos outside the facility’s gates, notably showing the incident’s intensity.

Charges and Defenses Collide

Alina Habba’s statement detailed the charges, emphasizing that Rep. LaMonica McIver’s Assault on ICE Officers involved impeding and assaulting federal officers.

“No one is above the law,” Habba declared, a stance Kristi Noem echoed, after she praised the charges via X, noting the need to protect law enforcement.

McIver’s lawyer, Paul J. Fishman, called the prosecution “spectacularly inappropriate,” per AP News.

Still, the McIver charged assault officers case underscores the risks officers face during such encounters.
