Pretrial hearing for Luigi Mangione to resume Monday after court releases new evidence in CEO murder case

NEW YORK — Luigi Mangione, the man accused of murdering a CEO, is set to return to court this Monday as a judge deliberates over the admissibility of critical evidence in his upcoming murder trial.

The proceedings focus on the pieces of evidence collected following Mangione’s arrest, which his defense team argues were obtained unlawfully, before he was informed of his rights.

Over the weekend, the court approved the release of additional evidence. Among these items is a piece of paper with a to-do list, which prosecutors argue is linked to the murder of UnitedHealthcare CEO Brian Thompson. A folding knife, reportedly taken from Mangione’s pockets, was also presented.

Further complicating the case is a Greyhound bus ticket issued to “Sam Dawson,” one of several aliases prosecutors claim Mangione used. At the time of his arrest, Mangione allegedly identified himself as Mark Rosario, an identity matching a fraudulent New Jersey driver’s license.

In the ongoing pretrial hearing, Mangione’s lawyers are vigorously contesting the legitimacy of the evidence collection process, seeking to have it deemed inadmissible before the murder trial commences.

The defense is particularly focused on excluding a ghost gun and a journal discovered in Mangione’s backpack. The journal purportedly contains scathing comments about for-profit health insurance companies, which prosecutors believe demonstrate a motive.

Lawyers for Mangione claim he was not read his Miranda Rights before he was searched, after his arrest in Altoona, Pennsylvania.

Prosecutor say under Pennsylvania law, officers had a legal right to search the backpack.

Mangione’s arrest came after that 911 call after he was spotted at a McDonald’s. The 911 call was released for the first time last week in court:

McDonald’s Manager: “I have a customer here that some other customers were suspicious of, that he looked like the CEO shooter from New York.”

911 Dispatcher: “You said black jacket?”

McDonald’s Manager: “Uh huh. A tan beanie.”

911 Dispatcher: “OK.”

McDonald’s Manager: “And like the blue medical mask.”

Mangione was last in court on Thursday. Proceedings in his ongoing pretrial hearing were canceled on Friday due to Mangione feeling sick.
