Rudy Giuliani got emotional in an interview on Tuesday night, waving around the federal indictment against Donald Trump and banging it onto his desk, as he railed against special counsel Jack Smith and defended the former president.

‘This this indictment is an outrage,’ Giuliani said during an interview with Newsmax’s Eric Bolling. ‘These crimes, these are very, very vague crimes.’

And he delivered a message to Smith as he raged on, slamming down the 45-page indictment to emphasize his point: ‘This one will be your legacy. Violating the right to free speech of an American citizen – nevermind whether he was president or not. It could be anybody. It could be a homeless person.’

He addressed the special counsel directly: ‘You don’t get to violate people’s first amendment rights Smith. No matter who the hell you are, no matter how sick you are with Trump derangement syndrome.’

Guiliani served as Donald Trump’s personal attorney and oversaw the efforts to have the 2020 election results be declared fraudulent in an attempt to overturn Joe Biden’s victory.

On Tuesday, Trump was indicted on four federal counts, including conspiracy to defraud the U.S. government and obstruct the electoral count, for trying to overturn the 2020 election.

The former president, who is facing a maximum of 55 years in prison on the four counts, has been summoned to appear before U.S. District Judge Tanya S. Chutkan – an Obama appointee – on Thursday in Washington, D.C. 

Smith’s indictment of Trump also lists six unnamed co-conspirators, who prosecutors say worked with the former president in seeking to overturn the 2020 election. 

Trump and his co-conspirators ‘used knowingly false claims of election fraud’ to try to ‘subvert the legitimate election results and change electoral votes’ to take down Joe Biden, according to the indictment. 

The co-conspirators were not charged and it’s unclear if they could be at a later date.

Giuliani appears to match the description of the first co-conspirator: an ‘attorney who was willing to spread knowingly false claims and pursue strategies that the Defendant’s 2020 re-election campaign attorneys would not.’

But the former New York City mayor wouldn’t confirm he was that person. 

‘I have not really no way I can confirm or deny that because they have not sent me a target letter or a subject letter and any kind of letter,’ he told Bolling during the Newsmax interview.

His attorney had a different answer.

‘It appears that this indictment alleges that Mayor Giuliani is co-conspirator #1,’ Giuliani attorney Robert Costello said in a statement Tuesday. 

Costello denounced the indictment, saying that it amounted to ‘election interference’ and ‘eviscerates the First Amendment.’

Giuliani also claimed the indictment was an attack on Trump’s first amendment right of free speech.

‘This is a historic and very, very sad indictment, because it’s probably one of the biggest attacks the United States government has made our free speech in our very, very long and illustrious history,’ he said.

‘It’s a disgrace what he’s done, and I don’t care if you hate Donald Trump – it’s a violation of his right of free speech,’ he added.

Giuliani argued Smith and his team of prosecutors should be the ones getting indicted. 

‘They should be indicted for conspiracy against rights for bringing this indictment,’ he said.

Giuliani, meanwhile, is facing separate legal troubles. He is being sued by two Georgia election workers for defamation over his allegations they engaged in election fraud while counting ballots at State Farm Arena in Atlanta.

Last month, he conceded he had defamed Ruby Freeman and Wandrea ‘Shaye’ Moss. 

Their lawsuit says Giuliani repeatedly pushed debunked claims that Freeman and Moss – mother and daughter – pulled out suitcases of illegal ballots and committed other acts of fraud to keep Trump from winning.

Giuliani acknowledged in a court filing that the statements were false, but he did not concede that they caused any damage to Freeman or Moss. 

Plaintiffs in a defamation case must prove not only that a statement made about them was false but that it also resulted in actual damage.
