The FBI, under the guidance of the Justice Department, clandestinely delved into a vast collection of phone calls, text messages, and personal financial data spanning two years belonging to Kash Patel, an influential figure in the Trump administration and now the FBI Director. This investigation, spearheaded by Special Counsel Jack Smith, aimed to scrutinize potential meddling in the 2020 presidential election. Among those targeted by subpoenas were Patel, who was then a private citizen, and eight others, including Susie Wiles, currently serving as Donald Trump’s Chief of Staff. Although the FBI’s investigation of Patel commenced in 2022 and was previously reported, the full scope of the data gathering was not known until now.
Lawmakers Release Documents Ahead of ‘Arctic Frost’ Hearing
In addition to communication records, Smith’s team sought an extensive array of personal information, including online usernames, mailing and email addresses, billing records, IP addresses, and bank account details. This was revealed in documents released by Senators Chuck Grassley, Ted Cruz, and Ron Johnson ahead of a Judiciary Committee hearing concerning Smith’s investigation, which bore the code name Arctic Frost. During his tenure in the Trump administration, Patel held prominent national security positions and served as chief of staff to the acting Defense Secretary leading up to the events of January 6. Between his government roles, he managed a legal defense non-profit organization.
Subpoenas Target Call Logs and Account Metadata
The subpoenas requested not just the logs of calls and texts sent and received, but also session times, call durations, and subscriber details for Patel’s accounts. Notably, the subpoenas covered a timeframe stretching from January 1, 2021, to November 23, 2023. In his opening statement at the Judiciary Committee hearing, Chairman Grassley highlighted that the records included a “wish list” crafted by Smith’s team, which identified 14 members of Congress for potential investigation, some of whom are currently members of the Committee itself.
FBI spokesman Ben Williamson told Reuters that the records show improper actions by Smith and the FBI at the time. ‘The FBI under prior leadership was weaponized in ways the American people are only now beginning to fully grasp,’ Williamson said. A separate document released by Grassley last year revealed that Republican lawmakers, including members of his own committee, were swept into the probe of the January 6 Capitol riot.
Republican Senators Lindsey Graham, Bill Hagerty, Josh Hawley, Dan Sullivan, Tommy Tuberville, Ron Johnson, Cynthia Lummis and Marsha Blackburn, were probed, according to the FBI document published by Grassley. Pennsylvania’s Republican Representative Mike Kelly was also investigated, according to the document. The one-page file was created during Smith’s Arctic Frost investigation, which probed both the riot and election interference claims.
The file sheds light on how the FBI conducted its investigation and used phone records to track sitting lawmakers. It is titled CAST Assistance, which refers to the agency’s cellular analysis survey team. The file is dated September 27, 2023, confirming the investigation into Republican lawmakers’ cellular data ran well into Biden’s presidency.
