Apple has filed a lawsuit against Sand Media, the owner of the Apple Cinemas chain, accusing them of trademark infringement, as detailed by Reuters. In the complaint, Apple claims that Apple Cinemas and Sand Media are attempting to “leverage the reputable Apple brand during their ambitious expansion across the country” and have “ignored Apple’s numerous attempts to settle the issue peacefully.”
Apple argues that “consumers might enter an ‘Apple Cinemas’ venue under the false impression that it is linked to the renowned Apple brand, with its significant reputation and brand value, even though Apple Cinemas has absolutely no ties to Apple.”
Apple Cinemas didn’t immediately reply to a request for comment.
According to Apple, Apple Cinemas has primarily operated in “a few New England suburbs and city outskirts.” However, they have recently opened a theater in the San Francisco Bay Area, just 50 miles from Apple’s Cupertino headquarters, with plans for another opening soon.
Apple claims that “the actions of the Defendants have already led to customer confusion and weakened Apple’s brand.” The lawsuit provides evidence of social media posts questioning any connection between Apple Cinemas and Apple. Additionally, it highlights that “media reports of theater openings on both coasts felt compelled to clarify that Apple Cinemas was not associated with Apple Inc.,” and includes examples. The lawsuit also mentions that Apple Cinemas intends to pursue an “aggressive national expansion to 100 theaters.”
