IMPORTANT ADVISORY: New travel restriction for H-1B visa holders

Hi everyone—We have examined the full text of today’s Presidential Proclamation on H-1B visas, which is available here: Restriction on Entry of Certain Nonimmigrant Workers – The White House.

Here’s what you need to know:

Firstly, this proclamation is designed as a travel restriction. Starting at 12:01 am eastern time on September 21, 2025 (which is 9:01 pm Pacific time tomorrow), individuals will be prohibited from entering or returning to the U.S. in H-1B status unless their petition includes an additional $100,000 payment.

What you need to do:

I will be updating this post later tonight with a form for those currently outside the U.S. with an H-1B visa. Our goal is to follow up with each person to provide support and guidance as they attempt to return within the next 28 hours.

The proclamation does not impact any other visa statuses.

There are additional details regarding the pause in processing H-1B petitions for those outside the U.S. At this juncture, we do not believe this immediately affects extensions of H-1B status or status changes to H-1B for those already in the U.S. We’ll provide further updates on that soon.
