FTC v. Meta: The antitrust battle over WhatsApp and Instagram

The long-anticipated antitrust trial involving Meta and the Federal Trade Commission began on April 14th. Chief Judge James Boasberg of the DC District Court is expected to spend around two months hearing cases about whether the company, formerly known as Facebook, unlawfully dominated the “personal social networking services” market by acquiring Instagram and WhatsApp.

The FTC originally filed this case in late 2020. Although the judge initially dismissed it, he allowed a revised version to continue once the government provided more detailed reasons for considering Meta a monopoly. This stage of the trial will assist the judge in deciding if Meta has indeed violated antitrust laws. Should the judge confirm this, he will later determine the appropriate actions to rectify the situation. The FTC advocates for the separation of Instagram and WhatsApp from Meta.

This trial marks the third attempt in the U.S. to dismantle major tech companies recently, following the Justice Department’s two individual lawsuits against Google concerning its search and advertising technology operations.
