In a bold legal move, Anthropic has initiated a lawsuit against the Department of Defense, challenging its recent classification as a supply chain risk. This contentious label, typically reserved for foreign entities deemed a national security threat, has sparked a spirited debate within the tech community. In a show of solidarity, nearly 40 prominent figures from OpenAI and Google, including Google’s chief scientist Jeff Dean, have filed an amicus brief supporting Anthropic’s stance. These tech leaders voiced their apprehensions about the Trump administration’s decision and highlighted the broader implications of the technology at stake.
The backdrop to this lawsuit is a tumultuous period for Anthropic, marked by its refusal to compromise on two critical principles concerning military use of its technology: opposition to domestic mass surveillance and resistance to fully autonomous weapons systems devoid of human oversight. These steadfast positions led to a breakdown in negotiations with the government, culminating in the supply chain risk designation. The aftermath saw a flurry of public criticism and other AI firms stepping in to take advantage of the situation by agreeing to less restrictive terms regarding military contracts.
Being labeled a supply chain risk carries significant consequences for Anthropic. It not only bars the company from securing military contracts but also poses challenges for other firms using Anthropic’s products in their work with the Pentagon. These companies are compelled to discontinue using Anthropic’s Claude model to preserve their profitable government contracts. Despite this designation, Anthropic’s technology remains deeply embedded within the Pentagon, evidenced by its reported use in a recent military operation targeting Iran’s Ayatollah Ali Khamenei, just hours after the designation was publicly announced by Defense Secretary Pete Hegseth.
The amicus brief, filed by key figures from the tech industry, argues that the supply chain risk designation is an unjust retaliation that undermines the public interest. It emphasizes the legitimacy of Anthropic’s concerns, particularly the potential dangers posed by AI-enabled mass surveillance and fully autonomous lethal weapon systems. The brief calls for a re-evaluation of these issues, warning of the profound risks they pose to democratic governance and global security.
The signatories of the brief identify themselves as professionals deeply immersed in the development and deployment of advanced AI systems across critical sectors like national security and military operations. They stress that their insights are offered not as representatives of any single corporation but as individuals with firsthand knowledge of the capabilities and limitations of AI technologies. Their collective message highlights the urgent need for legal and ethical frameworks to keep pace with the rapid evolution of AI deployment.
“We build, train, and study the large-scale AI systems that serve a wide range of users and deployments, including in the consequential domains of national security, law enforcement, and military operations,” the group wrote. “We submit this brief not as spokespeople for any single company, but in our individual capacities as professionals with direct knowledge of what these systems can and cannot do, and what is at stake when their deployment outpaces the legal and ethical frameworks designed to govern them.”
On the domestic mass surveillance front, the group said that though data on American citizens exists everywhere in the form of surveillance cameras, geolocation data, social media posts, financial transactions, and more, “what does not yet exist is the AI layer that transforms this sprawling, fragmented data landscape into a unified, real-time surveillance apparatus.” Right now, they wrote, these data streams are siloed, but if AI were used to connect them, it could combine “face recognition data with location history, transaction records, social graphs, and behavioral patterns across hundreds of millions of people simultaneously.”
When it comes to lethal autonomous weapons specifically, the group said that they can be unreliable in new or unclear conditions that don’t align with the environment they were trained in — meaning that they “cannot be trusted to identify targets with perfect accuracy, and they are incapable of making the subtle contextual tradeoffs between achieving an objective and accounting for collateral effects that a human can.” Additionally, the group wrote, lethal autonomous weapons systems’ potential for hallucination means that it’s important for humans to be involved in the decision-making process “before a lethal munition is launched at a human target” — especially since the system’s chain of reasoning is often not available to operators and unclear even to the system’s developers.
The group behind the amicus brief wrote, “We are diverse in our politics and philosophies, but we are united in the conviction that today’s frontier AI systems present risks when deployed to enable domestic mass surveillance or the operation of autonomous lethal weapons systems without human oversight, and that those risks require some kind of guardrails, whether via technical safeguards or usage restrictions.”
