A tragic incident at one of Canada’s prestigious private schools has left a community mourning the loss of a promising 12-year-old student. The young boy was allegedly struck and killed by a notorious teenage street racer, known for sharing disturbing images of the aftermath. Despite the gravity of the situation, no criminal charges have been filed.

Xavier Rasul-Jankovics, a student celebrated for his intelligence and athleticism at Queen Margaret’s School, met with a fatal accident while rollerblading alongside his father and older brother on a serene country road in the Cowichan Valley.

The incident occurred just after 8:30 p.m. on August 25, as the family concluded their final practice session in preparation for Xavier’s hockey tryouts scheduled for the following day.

In a sudden and devastating moment, a speeding Honda Civic barreled down Hillbank Road, hitting Xavier and subsequently crashing into a utility pole.

Eyewitnesses reported that the car was traveling at an alarmingly high speed. The impact flung Xavier nearly 185 feet, and he tragically passed away in his father’s arms.

The alleged driver, who remains unnamed due to Canadian legal restrictions, was 17 at the time and has since turned 18. He emerged from the crash unscathed, while his girlfriend, who was a passenger in the car, sustained only a minor injury to her ankle.

A source close to Xavier’s family claimed the alleged driver ‘appeared indifferent’ after the crash that killed the youngster.  

‘He got out of the car and took photos of the scene for his Snapchat,’ the Daily Mail’s source alleged. 

Shortly after the crash, photos of the scene, including images showing Xavier’s blood on the road, were allegedly posted to Snapchat by the alleged driver.

Another photo posted to Snapchat by the alleged driver on the night Xavier was killed tagged Victoria General Hospital in Victoria, British Columbia and saw the alleged driver write that he and his girlfriend were ‘ok.’  

Photos obtained by Daily Mail show the aftermath of the crash, including a Honda Civic with a license plate matching one seen in TikTok videos previously posted by the alleged teenage driver. 

The teen accused of driving into Xavier previously used social media to boast about speeding and reckless driving, maintaining an account dedicated to showcasing his illegal behavior behind the wheel.

In one post, he predicted that that he’d ‘one day die going 200mph’ but assured followers he would be ‘smiling at the end.’

A second post talked of taking life for granted ‘until you’re going sideways at a pole at 80.’

Though the accounts have since been made private, the images and posts have been verified as being posted by the alleged driver by sources close to the Xavier’s family.

Despite the gravity of the incident and the teen’s documented history of dangerous driving, no charges have been filed.

Police say the investigation is ongoing but Xavier’s family fear it could be years before a court case is brought, if ever. 

Sources familiar with the case say the alleged driver has not cooperated with investigators and has yet to be interviewed.

Under Canadian law, individuals cannot be compelled to speak to police unless formally charged. 

RCMP have confirmed that speed was a key factor in the crash but have not publicly identified the driver.

A spokesperson told the Daily Mail that an investigation was ongoing and that no charges had been brought against the alleged teenage driver.

The teenager and his parents did not respond to questions put to them by the Daily Mail.  

Xavier’s family is now pushing for legislative reform. They’ve proposed Xavier’s Law, which would automatically suspend the license and insurance eligibility of anyone involved in a fatal crash caused by dangerous driving until their case is resolved.

The proposal mirrors Ontario’s Andrew’s Law, named after Andrew Cristillo, a father of three killed by a dangerous driver. 

That law would impose immediate driving bans and lifetime suspensions for those convicted of extreme reckless driving.

Premier David Eby has spoken with Xavier’s parents and confirmed the province is reviewing potential changes. 

A petition supporting Xavier’s Law has already drawn more than 8,500 signatures, just shy of the 10,000 needed to bring it to court.

More than 2,000 people attended Xavier’s funeral in Duncan, with another 23,000 joining online. 

A memorial hockey tournament took place from October 11 to 13, and a scholarship fund in his name has raised over $130,000.
