'Horny' nurse caught raping stepson takes light sentence in plea deal

A  nurse who was caught raping her stepson by her husband has accepted a plea deal that will see her handed a light prison sentence. 

Alexis Von Yates, 34, entered a plea of no contest to a charge of lewd and lascivious battery inside an Ocala, Florida, courtroom on Thursday. Initially, she had been charged with sexual battery on a person aged between 12 and 18 years.

The plea deal will see her spend two years in prison, followed by two years of community control and ten years of sex offender probation. 

Von Yates will also have to complete 200 hours of community service, cover court costs and pay fines.

While accepting the plea, the judge said the penalty is a ‘significant downward departure’ from typical sentencing guidelines.

Prosecutors noted the victim’s family supports the plea agreement as it spares the 15-year-old boy from testifying at trial, which could disrupt his ongoing mental health treatment, according to CourtTV.

Von Yates, a former health care professional, was arrested and charged last year following the incident last July. 

Court documents at the time of her arrest revealed that her husband Frank, a linesman, had walked in on Von Yates sexually assaulting his son.

The child spoke with investigators last August, saying he had been in Florida on vacation to visit his father over the summer. 

The teenager detailed in graphic terms how he engaged in sexual activity with Von Yates after they spent time vaping cannabis oil, playing video games, and watching a movie together.

Von Yates started telling the teenager ‘how horny’ she was after not having sex for two weeks because she had been on her period. 

He told investigators Von Yates had made jokes about her sexual appetite the whole week before they had sex.

He described in detail how he started kissing her neck, with Yates saying: ‘I wish you were 18, because you’re not old enough.’

Von Yates then kicked off her underwear before engaging in oral sex and intercourse without the use of a condom, the teen said.

According to the affidavit, Von Yates would occasionally say ‘oh f***’ and ‘this is so bad’ during the tryst. 

The documentation further describes how they ‘heard something in the garage’ but ‘kept going’ until the boy’s father walked in after returning from working a late shift.

When his father walked in, the teenager told investigators he ran to the bathroom with his pants around his ankles. 

The boy said when questioned by his father he refused to tell him what had happened, and Von Yates told her husband she had asked the boy to stop. 

According to the affidavit, the boy insisted that wasn’t true and feared his father was going to beat him with a belt.

Von Yates is also said to have told the boy’s father she had sex with him because he looked like his dad when he was younger, the boy claimed. 

She also claimed her victim’s penis looked like a more youthful version of her husband’s.  

Following the assault, the boy was taken to his grandparents’ house, with his father telling him on the way that he had ‘ruined his life’.

According to the teen, his father stopped on the way for a six-pack of beer and was drink driving.

Once at his grandparents’ home, the boy said his grandfather discouraged him from calling his biological mother to tell her what had happened.

The following day the teen called Von Yates who told him he wished his father hadn’t caught them, the affidavit adds. 

In October, the victim’s father eventually sent an anonymous tip to police about the incident, the affidavit says.

The documents state an unknown person named ‘Kaylee’ reached out to the teen, saying his father was willing to protect him ‘if he testify’.

The teenager was informed that his father no longer wished to live with his stepmother. Von Yates was arrested in November on a charge of sexual battery involving a minor.

According to the arrest report, several of the teens’ relatives tried to discourage him from disclosing to police what had happened.

Her nursing license was suspended following her arrest, Florida officials said.

Von Yates is set to be sentenced on September 16 when the victim and his biological mother will give victim impact statements to the court.
