Supreme Court Justice Barrett Defends Dobbs Decision, Says Judges Should 'Tune Out' Critics Like Hillary

Supreme Court Justice Amy Coney Barrett justified the 2022 Dobbs ruling that overturned Roe v. Wade, asserting it was a states’ rights matter that should be “properly left to the democratic process.” In an interview on CBS’ “Face the Nation” on Sunday with host Norah O’Donnell, Barrett also emphasized that justices should “tune out” the criticisms from figures such as former Secretary of State Hillary Clinton.

“Dobbs did not make abortion illegal. It did not state whether abortion is immoral. It determined that these issues are for the states to decide. All these questions, decisions that require medical judgments, are not linked to the courts by our Constitution, regarding how far into pregnancy abortion rights should extend. Previously, the court was involved in defining many of these lines, and Dobbs asserts that these decisions should be left to the democratic process. States have been navigating this, with significant legislative and state constitutional activities occurring since Dobbs was decided,” Barrett explained.
