Michael Nachmanoff serves as a Judge in the U.S. District Court for the Eastern District of Virginia. He was nominated for this position by former President Joseph R. Biden Jr. on July 13, 2021, taking over the role from Anthony John Trenga. The Senate confirmed him on October 27, 2021, and he officially began his duties on November 2, 2021.

Before his federal court appointment, Judge Nachmanoff was a U.S. Magistrate Judge in the U.S. District Court for the Eastern District of Virginia, a role he held from 2015 to 2021.

Before becoming a magistrate judge, Nachmanoff worked at the Office of the Federal Public Defender for the Eastern District of Virginia for 13 years. During his tenure, he was the Chief Federal Public Defender from 2007 to 2015, Acting Federal Public Defender from 2005 to 2007, and First Assistant Public Defender from 2002 to 2005.

From 1996 to 2002, Nachmanoff practiced law privately. He joined Cohen, Gettings & Dunham, P.C., becoming a partner from 2000 to 2002, after serving as an associate from 1996 to 2000.

He held the position of president of the Northern Virginia Chapter of the Federal Bar Association (FBA) and contributed to the Board of Directors of the FBA’s Criminal Law Section. Additionally, Nachmanoff was a Board member of the Historical Society for the United States District Court for the Eastern District of Virginia.

Nachmanoff graduated from Wesleyan University with a B.A. in 1991 and earned his J.D. from the University of Virginia School of Law in 1995. He clerked for Judge Leonie M. Brinkema of the U.S. District Court for the Eastern District of Virginia from 1995 to 1996, and during 1994 to 1995, he was a third-year practitioner at the Albemarle County Commonwealth’s Attorney’s Office.

Nachmanoff was a summer associate at Akin Gump Strauss Hauer & Feld LLP in 1994 and a Summer Law Clerk for the United States Attorney’s Office for the Eastern District of Virginia in 1993. He was also a Paralegal Specialist at the U.S. Department of Justice’s Office of International Affairs, Criminal Division, from 1991 to 1992.

U.S. District Judge Michael Nachmanoff was randomly assigned to oversee the politically charged indictment of former FBI Director James Comey. Comey is set to be arraigned on Oct. 9 before Nachmanoff’s Alexandria courtroom, where he is expected to enter a plea.

President Donald Trump indicated that a “Crooked Joe Biden appointed Judge” could bode well for Comey.

“He is a Dirty Cop, and always has been,” Trump said of Comey in a Truth Social post, “but he was just assigned a Crooked Joe Biden appointed Judge, so he’s off to a very good start.”

Comey is facing one charge of making a false statement to Congress and one charge of obstructing justice. He denied the allegations in a statement through his attorney Patrick Fitzgerald, a former U.S. attorney and special counsel.

“Jim Comey denies the charges filed today in their entirety. We look forward to vindicating him in the courtroom,” Fitzgerald said.

Comey professed his innocence in a video posted to social media soon after the indictment was publicly filed.

“My heart is broken for the Department of Justice, but I have great confidence in the federal judicial system,” Comey said. “And I’m innocent. So, let’s have a trial. And keep the faith.”
