In a significant legal development, a federal judge in Illinois has ruled that the Trump Administration breached the First Amendment by pressuring tech giants Facebook and Apple to remove groups and applications designed to track ICE activities. Judge Jorge L. Alonso, presiding over the Northern District of Illinois, sided with the plaintiffs, Kassandra Rosado, who manages the Facebook group “ICE Sightings – Chicagoland,” and the Kreisau Group, creators of the “Eyes Up” app, granting them a preliminary injunction.

Judge Alonso referenced a landmark 2024 Supreme Court ruling that involved the NRA and Maria Vullo, the former superintendent of New York’s Department of Financial Services. The court had unanimously determined that government officials are prohibited from coercing private companies to suppress or punish disfavored viewpoints. In his decision, Alonso emphasized that former Attorney General Pam Bondi and South Dakota Governor Kristi Noem overstepped by insisting, rather than merely requesting, that Facebook and Apple censor the plaintiffs’ content.

The controversy surrounding the ICE Sightings Facebook group escalated when Pam Bondi publicly claimed on social media platform X that a group accused of “doxing and targeting” ICE agents was removed following intervention from the Department of Justice. Furthermore, apps like “Eyes Up,” “ICEBlock,” and “Red Dot,” among others, were similarly taken down from app stores after DOJ pressure and threats of legal action, which extended to media outlets such as CNN for merely reporting on these apps.

An appeal from the government is anticipated, prolonging this legal confrontation. However, given the Supreme Court’s unanimous 2024 decision, the Trump Administration may encounter considerable challenges in overturning Judge Alonso’s ruling.
