Ex-Overstock CEO Defies Judge on LindellTV, Lawyers Notice

Before Hunter Biden secured a default defamation victory against Patrick Byrne, Biden’s lawyers drew a pointed comparison: They said the former Overstock chief executive resembled other high-profile figures already found to have defamed others, yet who kept publicly repeating the same false claims even as serious legal consequences mounted.

Now, the election technology company once known as Dominion is adopting a similar approach, spotlighting Byrne’s combative appearances on Mike Lindell’s media platform as its own defamation case presses forward.

Dominion, which was later “rebranded” as Liberty Vote after a sale, has asked a federal court in Washington, D.C., to enter a formal default judgment against Byrne. The request reflects the company’s growing frustration after years of alleged noncompliance, procedural disputes, and courtroom turbulence in a long-running defamation lawsuit tied to false claims about the 2020 election.

In a motion filed on Aug. 13 before U.S. District Judge Carl Nichols, the company argued that Byrne has shown a “sustained and admitted commitment to violating this Court’s rules and orders,” leaving the case unable to proceed in any workable fashion.

“Plaintiffs thus respectfully request that the Court enter default judgment against him and schedule a short jury trial on damages only,” the motion states.

The filing points to a series of Byrne’s recent LindellTV comments as evidence of open defiance, including statements such as, “I just violated some federal judge’s orders. I don’t care” and “[s]crew you, judge. I’m ignoring your orders.”

As Law&Crime has previously detailed, much of Byrne’s grievance traces back to U.S. Magistrate Judge Moxila A. Upadhyaya’s 2024 removal of his “Kraken” attorney, Stefanie Lambert, from the case after a sweeping discovery breach.

Liberty Vote has finally had enough, and its lawyers with Susman Godfrey are urging Nichols to act accordingly, as the Donald Trump-appointed judge has in a case against the MyPillow CEO.

In one appearance on “The Absolute Truth,” Emerald Robinson’s LindellTV show, Byrne suggested the magistrate is compromised because of her past legal work for Nicolas Maduro’s government in Venezuela.

“I want to take these guys in and give them a thrashing in a D.C. courtroom that goes down in history, notwithstanding the prophylactic efforts of this smelly Indian mob lawyer, who’s been protecting — a magistrate judge protecting them,” Byrne was quoted saying on June 25. “And shame on Judge Nichols, you idiot, you deep state idiot, who’s been over — who had a mob lawyer from Venezuela acting as the impartial judge in our case. Screw you, judge. I’m ignoring your orders.”

Liberty Vote said Byrne “made one thing absolutely clear: He will not follow this Court’s orders,” even if that means “sharing the entire database of Plaintiffs’ produced documents so scores of those documents could be posted on the Internet.”

The remedy for that is an entry of default, just as occurred in Georgia poll workers’ defamation case against Rudy Giuliani, the voting technology company says.

“Nobody put Mr. Byrne to that decision but himself,” the filing continues. “To the contrary, this Court gave Mr. Byrne extended opportunities to show that he could—and would—do just the opposite. But Mr. Byrne made his choice.”
