Nearly a month following the arrest of a 50-year-old woman accused of mistreating a toddler at a San Antonio childcare facility, the victim’s family has initiated a legal action.

According to a statement emailed to CrimeOnline by law firms Kherkher Garcia, LLP, and Ali Law Group, PLLC, a lawsuit was filed on February 5 against KIDUS Daycare, its parent company JPR International Inc., and Veronica Jimenez.

The complaint, lodged on behalf of Ali and Hoda Ibrahim, concerns their young child who was harmed while under Jimenez’s supervision on January 6. The incident reportedly took place in a classroom at the daycare situated on Bulverde Road.

Security footage shared with the legal firms captures Jimenez seizing a young boy by the arm, leading to his head hitting the ground after a fall. The lawsuit indicates the child was playing near a “rolling classroom caddy” when it tipped over.

“The footage shows daycare provider Veronica Jimenez reacting aggressively, appearing upset, and advancing towards the boy,” the lawsuit describes.

After examining the video, deputies from the Bexar County Sheriff’s Office apprehended Jimenez, charging her with felony injury to a child for reckless bodily harm.

Upon reviewing the footage, deputies with the Bexar County Sheriff’s Office arrested Jiminez. She’s been charged with felony injury to a child—reckless bodily injury.

Along with court costs and other damages, the defendants are seeking $1 million and $5 million for gross negligence, which includes:

  • Failure to adopt, enforce, and maintain reasonable safety measures
  • Negligent hiring, training, and supervision
  • Failure to maintain reasonable safety measures, including operational controls needed to protect children from injury

Jimenez has since been fired from her position at the daycare. KSAT 12 reports that she is also out of jail, on a $30,000 bond.

She’s expected back in court on April 7. Check back for updates.
