A Florida mother allegedly burned her 10-year-old daughter while the girl was restrained in a chair as punishment for misbehaving, then told investigators the injuries resulted from a cooking accident.

Gineth Ramirez, 35, faces a charge of aggravated child abuse with torture.

Investigators went to a Hialeah school on Sept. 9 after the girl accused her mother of abusing her. The child said Ramirez burned her arms and legs because she “misbehaves,” according to a probable cause arrest affidavit. Authorities observed burn marks on her forearm, shin and the inside of her upper thigh.

The girl told police that her mother made her sit in a chair, tied her hands behind her back with either a rope or handcuffs, and then burned her, officers wrote.

After being read her Miranda rights, Ramirez allegedly attributed the injuries to a kitchen accident that occurred about two weeks earlier. She said she and the girl had been making flan when the child asked for a taste. Ramirez allegedly handed her a spoonful and instructed her to blow on it because it was hot, the affidavit states.

According to Ramirez’s account, the girl dropped the spoon, causing the flan to land on and burn her leg. Ramirez reportedly offered no explanation for the other injuries and said she “never even knew about them,” police wrote.

Ramirez allegedly denied intentionally burning her daughter. She told investigators that when the girl misbehaves, she makes her sit in a chair and face a wall—but insisted she does not restrain her, according to the affidavit.

“The defendant said she never disciplines the victim by hitting her,” police wrote.

Police arrested Ramirez and booked her into the Miami-Dade County Jail, where she is being held without bond. Her bond hearing is scheduled for Tuesday morning, followed by an arraignment set for Oct. 13.
