A New Mexico man is accused of fatally shooting his cousin after a family dispute allegedly began with an argument over the spiciness of the enchiladas they were eating, law enforcement officials said.
Ervin Gutierrez, 22, is facing an open count of murder in connection with the death of Nathaniel Cavazos, 25, the Bernalillo County District Attorney’s Office announced in a news release.
Gutierrez is currently being held without bond at the Albuquerque Metropolitan Detention Center.
According to investigators, another cousin suggested the group take their dogs out for a walk in an effort to defuse the tension, but the disagreement allegedly escalated into a physical confrontation between Gutierrez and Cavazos.
The Albuquerque Police Department said Cavazos attempted to leave the fight, but Gutierrez allegedly drew a firearm and shot him multiple times.
Emergency responders arrived at the scene, but Cavazos was pronounced dead there, authorities said.
Police said Gutierrez later surrendered to authorities.
The defendant was booked into jail on Aug. 29 and he will remain in custody ahead of his trial. It is unclear when he is next scheduled to appear in court.
