Texas Father Charged with Capital Murder, 2-Month-Old Dies with Brain Bleed and Skull Fracture

The parents of a 2-month-old Texas baby are facing charges after police say the infant died from physical abuse.

As reported by Fox 26 Houston, Demari Ossain Alston, 27, is charged with capital murder, while his girlfriend, Trinity Nyomi Perez, 22, faces a felony charge for injuring a child.

Their son, Zayn Alston, passed away from blunt force injuries on September 11, 2024.

Court documents reveal that on September 9, 2024, an investigation was launched after Zayn received treatment at two different ERs for his injuries. Authorities were called to Memorial Hermann Hospital in Houston due to reports of the baby’s skull fracture, retinal hemorrhaging, and brain bleed.

Law&Crime stated that during questioning, both suspects gave statements voluntarily, with Alston allegedly asserting that he believed Zayn suffered an “allergic reaction.”

The affidavit detailed Alston’s account: “Alston said he is the last person to see [Zayn] alive,” it noted. “When asked why his son was brought to the hospital last night, your Affiant observed Mr. Alston say, ‘This s— is crazy. I am not going to lie.’”

“Mr. Alston said [Zayn] may be having an allergic reaction causing everything to swell because [Zayn] had not ever had problems breathing.”

Perez reportedly said she was in the living room of a Houston apartment when Alston, who was with the infant in a bedroom, mentioned he tripped over a shoe while carrying the baby.

During a search of Alston’s phone, investigators uncovered numerous incriminating search queries, including, in part:

  • Will you go to jail if you find your child unresponsive
  • my 2-month-old died is anyone getting charged

Court records stated that the infant had also been injured in July 2024, when he was 10 days old, with fractures to his arm, clavicle and ribs.

Zayn’s grandmother took him into her care, with the parents allowed to visit the baby during the day. The grandmother was reportedly in a spare bedroom when the September incident occurred.

An autopsy noted that Zayn had multiple blunt force injuries.

Alston remains behind bars at the Harris County Detention Center on a $2 million bond. Perez is behind bars on a $250,000 bond.
