In a tragic turn of events in Florida, a dispute over loud music has led to the death of a man, allegedly at the hands of his neighbor. Tony Deuser has been charged with second-degree murder following the incident, as confirmed by the Hernando County Sheriff’s Office. He is currently held without bond at the Hernando County Detention Center.
Defense attorney Jimmy Brown has announced that Deuser will plead not guilty to the charges. The legal proceedings will undoubtedly be closely watched as the case unfolds.
The incident occurred on April 7, when deputies were dispatched to a scene where they found 52-year-old Francis Biegaj suffering from a gunshot wound to his arm. Despite efforts to save him, Biegaj succumbed to his injuries, marking a grim conclusion to the dispute.
Witnesses have reported hearing several gunshots and subsequently seeing a man, identified as Deuser, leaving the vicinity with what appeared to be a pistol in hand. This testimony has become a crucial part of the investigation.
Following the incident, law enforcement, including SWAT and crisis response teams, surrounded Deuser’s home. Authorities managed to convince him to surrender peacefully, leading to his arrest. As the case moves forward, the community remains in shock over the violent escalation of what began as a neighborly disagreement.
After SWAT and crisis response teams surrounded his home, authorities eventually coaxed Deuser out, according to the release, and he was taken into custody.
Surveillance video showed the moments leading up to the shooting, with Deuser in Biegaj’s driveway while loud music came from an ATV, according to an affidavit for a search warrant obtained by Oxygen.
In the footage, Biegaj approached Deuser saying, “Get the f–k outta my yard.” Deuser then reached into his pants pocket and shot Biegaj.
Biegaj fled into his garage, per the warrant affidavit, but Deuser continued to fire in his direction before heading back home.
According to the warrant affidavit, Biegaj’s wife said her husband came inside calling her name before collapsing. She called 911 and attempted CPR.
Deuser later told investigators that Biegaj had been playing loud music for years, and that he brought a gun as a scare tactic because he didn’t think Biegaj would turn off the music, according to the warrant affidavit. When Biegaj refused to turn it off, said Deuser, he shot him and went home.
When police informed Deuser that Biegaj died, he said, per the warrant affidavit, “Well, that sucks.”
Deuser will next appear in court on June 2. He is facing a life sentence with no possibility of parole, his attorney told Oxygen.
