In a surprising turn of events, Donald Trump is now advocating for the renewal of a contentious surveillance measure, urging hesitant Republicans to support it despite his previous criticisms. The measure in question is a component of the Foreign Intelligence Surveillance Act (FISA), known as Section 702, which permits the warrantless monitoring of foreign nationals outside the United States. However, this provision has also allowed U.S. intelligence agencies to access communications between American citizens and individuals abroad, sparking controversy and resistance among Republicans who argue it has been misused, particularly against Trump himself.
The April 20 Countdown
Section 702 is set to lapse on April 20 unless Congress acts to renew it. Previously, the measure was utilized to surveil Trump’s associates during his 2016 presidential campaign, a move he has condemned for enabling unwarranted intrusions into his circle. In April 2024, as the renewal date approached, Trump vocally opposed the provision, stating, “Kill FISA, it was illegally used against me, and many others. They spied on my campaign!”
Tremendous Success
However, Trump’s stance has shifted dramatically in light of the ongoing conflict with Iran. He is now encouraging conservatives, who are cautious of the measure’s extensive reach, to back its renewal. Trump articulated on social media that Section 702 is crucial for military operations, citing its importance in recent successes on the battlefield in Venezuela and Iran. “Our Military desperately needs FISA 702, and it is one of the reasons we have had such tremendous success,” he posted, emphasizing that military leaders universally regard the provision as indispensable, especially amid current military endeavors in Iran.
The President met Speaker Mike Johnson at the White House on Tuesday to discuss the provision, which faces significant opposition within the Republican base. ‘I am working very hard with our Great Speaker, Mike Johnson, along with Chairman Jim Jordan and Chairman Rick Crawford, to get a clean extension of FISA 702 through the House of Representatives this week,’ Trump added.
That opposition was swift and vocal. ‘No FISA reauthorization without a warrant requirement for US citizens!’ Kentucky Republican Thomas Massie posted on X. Congresswoman Lauren Boebert went further: ‘An NSA analyst used Section 702 surveillance powers to spy on Americans he met on a dating app. This is exactly the kind of abuse that happens when we hand unchecked power to the intel community. No more treating Section 702 like a personal Tinder search. GET. A. WARRANT.’ Tennessee Republican Andy Ogles has claimed FISA allows authorities to ‘spy on nearly every influential conservative through the DOJ.’
