A jury has once again found a man guilty of manslaughter after he launched an unprovoked assault on a 73-year-old man at a service station.

During the trial, it was revealed that the attacker, Maskell, continued his aggression by walking over to the fallen Burke and delivering a kick as the elderly man lay helpless on the tiled floor.

Tragically, Burke succumbed to a brain injury and passed away 11 weeks later while in the hospital.

After deliberating for less than a day, the jury returned this afternoon with a unanimous verdict of “guilty” for the charge of manslaughter.

Justice James Elliott expressed his gratitude to the jury for their “very diligent” work before dismissing them.

He then instructed custody officers, “Please take Mr. Maskell away.”

Maskell will return to the Supreme Court tomorrow for a pre-sentence hearing.

He was jailed for eight years in 2023, with a non-parole period of five, after being found guilty of manslaughter in his first trial over Burke’s death.

However, Maskell successfully appealed this convictions with three Victorian Court of Appeal judges ordering he face a fresh trial in July 2025.

His conviction was set after the judges found there had been a substantial miscarriage of justice.
