The Federal Government is set to unveil new legislation aimed at curbing price gouging practices by major supermarket chains. This initiative marks a significant effort to ensure fair pricing and protect consumers from exploitative pricing strategies employed by large retailers.

Delivering on a major promise from this year’s election campaign, the Albanese Government is releasing draft legislation that would lead to major supermarkets facing heavy fines if they are found to be price gouging.
A report from the ACCC, Australia’s consumer watchdog, earlier this year recommended action be taken against “shrinkflation”, where products become smaller but are not reduced in price, as well as greater transparency on prices and loyalty programs and regulation of promotions offered by supermarkets.

Coles reported a profit of $1.08 billion at the end of the 2024-25 financial year, whilst Woolworths had a profit of $1.4 billion.

In light of recent financial disclosures, ALDI reported a substantial profit of $402 million for the year 2023. This figure underscores the profitability of major supermarket chains, which has drawn increased scrutiny from both regulators and the public.

The government’s proposed laws come as the second significant attempt to regulate the supermarket industry. Currently, the Competition and Consumer Amendment (Make Price Gouging Illegal) Bill is under consideration in the Senate, reflecting a broader political drive to address consumer concerns over pricing practices.

Adding to the regulatory pressures, Coles and Woolworths are entangled in a joint class action lawsuit. The legal action accuses these retail giants of misleading consumers through deceptive discount pricing schemes, further highlighting the need for stringent oversight in the sector.
