A debate about ‘two-tier’ policing has been sparked when a progressive TikTok influencer was excused after posting ‘kill them all’ following the murder of Charlie Kirk.

Kent Police’s choice not to charge Charlotte Hayes has caused widespread backlash online, including criticism from author JK Rowling and shadow justice secretary Robert Jenrick.

The prominently tattooed social media figure, who boasts 212,000 followers, shared a provocative video on TikTok after the pro-Trump influencer’s tragic shooting, claiming his supporters championed political beliefs labeled as ‘inherently violent’.

She expressed her frustration with the notion that you ‘cannot meet violence with violence’, questioning ‘why is anyone condemning that?’, and concluded her statement with the exclamation ‘kill them all!’.

Kent Police stated that officers visited Ms. Hayes but chose not to arrest her, opting instead to provide ‘words of advice’ after concluding that no legal offences were committed.

The 25-year-old later deleted the video, but not before it had gone viral on social media – racking up millions of views.

In the video she said: ‘I have opened X to a bunch of b*****s crying and whingeing about how political violence is never the answer.

‘These people are gunning for politics that is inherently violent to the population, to marginal people, to people who don’t have access to healthcare.

‘These people do not care if you live or die. They don’t as long as you can work for them and make them money and once you are useless, they don’t care. 

‘They want you to die. Why is anyone condemning that? F****** kill them all, kill them all.’

After footage of the video was widely shared on social media, the organisation that Mr Kirk founded, Turning Point USA, posted on Twitter/X to condemn them. It has also been critical of the police’s decision not to prosecute. 

Now Rowling and Jenrick have compared her treatment by the police to that of Graham Linehan, the comedian arrested for an anti-trans tweet, and Lucy Connolly, who was jailed for a tweet inciting violence in the wake of the Southport murders.

The Harry Potter author questioned the sense of a social media influencer escaping punishment after urging her followers to kill people with different political views. 

She drew a comparison to Father Ted creator Graham Linehan, who was arrested for saying that if a man refused to leave a women-only space, he should be punched in the balls.

Meanwhile Mr Jenrick said ‘the law is not being applied equally’ after drawing a comparison with the police’s decision in the case and Lucy Connolly’s treatment.

Mrs Connolly was jailed for 31 months after seemingly calling for people to ‘set fire’ to hotels housing asylum seekers in the wake of the Southport attack in July 2024.

Since being released after serving 40% of her sentence, she has said she was made to be ‘Sir Keir Starmer’s political prisoner’.  

Other examples of apparent ‘two tier policing’ include that of Dartford Labour councillor Ricky Jones, who was cleared of encouraging violent disorder despite calling for far-right activists’ throats to be cut in August last year.

Since the row broke out, mother-of-one Ms Hayes told the Telegraph that she regretted posting the video but said her words had been misconstrued.

She insisted the ‘kill them all’ line was satirical, borrowed from the quote ‘kill everyone now’ from 1972 cult film Pink Flamingos, which she had watched two days earlier.

‘It wasn’t a general statement about anyone who has Right-wing beliefs,’ she told the paper.

Ms Hayes compared her statement to the often-used Left wing battle cry ‘eat the rich’, adding: ‘Nobody is [really] going to cannibalise the rich.’

Toby Young, Lord Young of Acton and director of the Free Speech Union (FSU), said the instance was yet another example of a case in which the police should never have got involved – labelling it ‘an unpleasant bit of rhetoric’.

According to the activist, some of them have leaked her address and shared photos of her young son, adding that police had given her a portable panic alarm and installed security measures at her home.

She has also been evicted from the vintage clothing stall she recently set up at the Petticoat Lane Emporium in Folkestone, Kent.

When she arrived at work on Saturday, September 13, Richard Tozer, who owns the indoor market, told her she would have to leave after his business was targeted.

He told Kent Online things went ‘bonkers’, as the phones went crazy and people came in and threatened to damage her pitch.

A spokesman for Kent Police said: ‘Kent Police received allegations regarding a social media video posted on Saturday, September 13, 2025. 

‘Investigators examined the content and concluded no offences were committed. 

‘The person who posted the video was visited by officers and received words of advice. They subsequently deleted the post.’

The outrage over the case comes after Mr Kirk, who was a highly regarded star of the American right, was brutally shot dead at a Utah college event.

Mr Kirk, known for his fierce MAGA views and thrilling debates with college kids across the country, collapsed immediately after being hit by the gunfire.

The horrific crime has been mostly condemned across the political spectrum, although some left-wing social media fanatics have celebrated the murder – with some comparing him to Adolf Hitler and even suggesting he ‘deserved’ his fate.

English rap duo Bob Vylan were widely condemned after they celebrated Mr Kirk’s assassination with a vile onstage rant at a gig in the Netherlands. 

Meanwhile, other left-leaning ideologues made light of it, with one writing: ‘I’m not saying Charlie Kirk deserved to be shot, but I think enablers to paedophiles should be shot, too.’

Some TikTok users also reacted casually to Mr Kirk’s death, with one mock-crying while a dramatic song played, with the caption: ‘Charlie Kirk got s**t? Awwww.’

Another liberal posted: ‘Hitler giving Charlie Kirk a tour in hell’, adding a GIF from a TV show.

Another called Mr Kirk ‘a f***ing Nazi. And you know what kind of Nazi is the best Nazi? A dead one. Thank God that s***stain of a person is no longer in this world.’

Others mocked Mr Kirk’s steadfast commitment to open debate and exchange of ideas: ‘Why didn’t Charlie Kirk just debate the bullet? He would have easily deflected.’

The row over policing online comments like these comes after the National Police Chiefs’ Council, the Metropolitan Police and the College of Policing recently wrote to Shabana Mahmood, the Home Secretary, to push for legal changes.

Officers have been calling for clarity from the Government over criminal charges for comments made online.

Nick Smart, chairman of the Police Superintendents’ Association, said officers were being ‘set up to fail’ and needed clear guidance on whether they should arrest people for social media posts.
