Guatemalan national freed without bail in THC gummies case that sent 12 middle-schoolers to the hospital

A person from Guatemala was let out on his own recognizance on Thursday after being accused of distributing THC-infused gummies that led to a dozen middle school students in New York being hospitalized back in March.

Wilmer Castillo Garcia, aged 22, faces charges of child endangerment after 12 students from William Floyd Middle School were taken to Peconic Bay Hospital on the same day, as per Suffolk County District Attorney Raymond Tierney.

The students fell ill after consuming gummies containing THC, the psychoactive substance in cannabis that induces feelings of euphoria. An investigation linked the gummies to an Instagram account, which eventually pointed to Castillo Garcia, according to Tierney.

When asked about his client’s release, Tuohy said Castillo Garcia is not a flight risk.

“He retained legal counsel, voluntarily appeared in court, and demonstrated that he isn’t likely to flee,” Tuohy stated. “These are drug-related charges, not violent ones, meaning they’re not subject to bail. I also believe no one had the intention to cause harm. It’s an unfortunate scenario, and we aim to resolve it in the most favorable manner possible.”

Castillo Garcia is due back in court Sept. 2 and faces up to nine years in prison if convicted of the top count.
